These Terms of Use apply to your use of Recall, along with any associated software applications and websites (all together, “Services”). By using the Services, you agree to these Terms of Use.
Our Privacy Policy explains how we collect and use personal information. Although it does not form part of these Terms, it is an important document that you should read.
Registration and access
Minimum age. You must be at least 13 years old or the minimum age required in your country to consent to use the Services.
Account security. You are responsible for keeping your account credentials safe and for all activities that occur under your account.
Using our Services
Prohibited use. You may not use our Services for any illegal, harmful, or abusive activity. For example, you may not:
- Use our Services in a way that infringes, misappropriates or violates anyone’s rights.
- Interfere with or disrupt our Services, including circumvent any rate limits or restrictions.
Feedback. We appreciate your feedback, and you agree that we may use it without restriction or compensation to you.
Content and intellectual property
Your private decks. You retain ownership of any private decks you create on Recall. Recall does not claim ownership of your content.
Decks you publish to the Deck Library. By publishing a deck to the Deck Library, you grant Recall a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, distribute, and make technical modifications to the deck solely to operate, maintain, improve, and promote the Recall service. You represent and warrant that you have all rights necessary to publish the deck and grant this license, and that doing so does not infringe any third-party rights.
Decks you save from the Deck Library. Decks in the Deck Library are provided for personal, non-commercial use only. You may save, modify, and use these decks for your own personal purposes. You may not sell, redistribute, publicly share, sublicense, or otherwise use them for commercial purposes, whether modified or not, without permission from the rights holder.
Copyright complaints. If you believe content on Recall infringes your copyright, please contact us at contact@recall.cards with sufficient information to identify the content and your rights.
Paid subscription
Billing. When you subscribe to a paid plan, you will provide complete and accurate billing information, including a valid payment method. We will automatically charge your payment method on each agreed-upon periodic renewal until you cancel.
Cancellation. You can cancel your paid subscription at any time in your account settings. Payments are non-refundable, except where required by law.
Termination
You are free to stop using our Services at any time. We reserve the right to suspend or terminate your access to our Services or delete your account if we determine you breached these Terms or we must do so to comply with the law.
Upon termination, your right to use the Services will end. We may delete or retain your content in accordance with our Privacy Policy and applicable law.
Discontinuation of Services
We may decide to discontinue our Services, but if we do, we will give you advance notice and a refund for any prepaid, unused Services.
Disclaimer of warranties
Recall is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Recall disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Recall does not warrant that Recall will be uninterrupted, error-free, secure, or free of bugs or viruses, or that any content, including decks available through the Deck Library, will be accurate, complete, or reliable. Your use of Recall and any content obtained through the service is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Recall and its founders, employees, affiliates, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of, or inability to use, Recall or any content made available through the service.
In no event will Recall’s total liability for any claims relating to the service exceed the amount you paid to Recall (if any) in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
General
Governing law. These Terms of Use are governed by and construed in accordance with the laws of Singapore, without regard to its conflict of laws principles. You agree that the courts of Singapore will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
Changes. We are continuously working to develop and improve our Services. We may update these Terms or our Services accordingly from time to time. If we make material changes, we will provide you with notice through the Services or by other means. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the changes, you must stop using our Services.
